A significant change has been made in New York in regard to divorce, finally granting "no-fault" divorces. New York was the last state in the U.S. to pass laws of this kind. In the past, the requirement that spouses file for divorce based upon specific "grounds" prolonged and aggravated the divorce process. Today, to file for divorce you must meet the state's residency requirements and can choose whether to file for divorce based upon certain grounds or upon the basis that the marriage is irretrievably broken for a period of six months prior to the commencement of the action by stating so in a sworn statement made under oath.
Even in a no-fault divorce, however, one spouse may choose to contest the action, or by raising issues in regard to custody, support, or property division as the no fault ground can only be used when all other issues are resolved.
